Article L4022-2 of the French Public Health Code

I.- As part of the certification defined in article L. 4022-1, healthcare professionals must establish, over a period of six years, that they have carried out a minimum programme of actions aimed at:

1° Updating their knowledge and skills;

2° Reinforcing the quality of their professional practices;

3° Improving their relationship with their patients;

4° Taking better account of their personal health.

II.-Actions carried out in the context of continuing professional development, continuing education and accreditation are taken into account when complying with the obligation to undergo periodic certification.

III. -Each healthcare professional chooses, from among the actions provided for in the periodic certification reference framework defined in article L. 4022-7 which apply to him/her, those which he/she intends to follow or carry out during the period mentioned in I.

For salaried professionals, this choice is made in conjunction with the employer in accordance with procedures defined by decree.

For healthcare professionals subject to the provisions of article L. 4138-2 of the Defence Code, this choice is made with the agreement of the military authority.

Article L4022-2

I.-Au titre de la certification définie à l’article L. 4022-1, les professionnels de santé doivent établir, au cours d’une période de six ans, avoir réalisé un programme minimal d’actions visant à :

1° Actualiser leurs connaissances et leurs compétences ;

2° Renforcer la qualité de leurs pratiques professionnelles ;

3° Améliorer la relation avec leurs patients ;

4° Mieux prendre en compte leur santé personnelle.

II.-Les actions réalisées au titre du développement professionnel continu, de la formation continue et de l’accréditation sont prises en compte au titre du respect de l’obligation de certification périodique.

III.-Chaque professionnel de santé choisit, parmi les actions prévues au référentiel de certification périodique défini à l’article L. 4022-7 qui lui sont applicables, celles qu’il entend suivre ou réaliser au cours de la période mentionnée au I.

Pour les professionnels salariés, ce choix s’effectue en lien avec l’employeur selon des modalités définies par décret.

Pour les professionnels de santé relevant des dispositions de l’article L. 4138-2 du code de la défense, ce choix s’effectue après accord de l’autorité militaire.
