Article L411-1 of the French Intellectual Property Code

The Institut national de la propriété industrielle is a public establishment with legal personality and financial autonomy, reporting to the Minister responsible for industrial property.

The mission of this establishment is:

1° To centralise and disseminate all information necessary for the protection of innovations and for the registration of companies, as well as to undertake any awareness-raising and training activities in these areas;

2° To apply the laws and regulations relating to industrial property; to this end, the Institute provides, in particular, for the receipt of applications for industrial property titles or ancillary industrial property titles, for their examination and grant or registration and for the supervision of their maintenance; it hears applications for invalidity and revocation of trademarks mentioned in 1° and 2° of I of Article L. 716-5, as well as oppositions lodged against patents for invention; it ensures the dissemination of technical, commercial and financial information contained in industrial property titles; it rules on applications for approval or modification of the specifications of geographical indications defined in article L. 721-2;

2-1° To apply the provisions of the Commercial Code relating to the keeping of the national register of companies provided for in article L. 123-36 of this code, the prerogatives associated with it and the free dissemination of information to the public;

3° Taking any initiative with a view to the ongoing adaptation of national and international law to the needs of innovators and businesses; in this respect, it proposes to the Minister responsible for industrial property any reform it considers useful in these matters; it participates in the drafting of international agreements and in representing France in the competent international organisations.

Article L411-1

L’Institut national de la propriété industrielle est un établissement public doté de la personnalité civile et de l’autonomie financière, placé auprès du ministre chargé de la propriété industrielle.

Cet établissement a pour mission :

1° De centraliser et diffuser toute information nécessaire pour la protection des innovations et pour l’enregistrement des entreprises, ainsi que d’engager toute action de sensibilisation et de formation dans ces domaines ;

2° D’appliquer les lois et règlements en matière de propriété industrielle ; à cet effet, l’Institut pourvoit, notamment, à la réception des dépôts de demandes des titres de propriété industrielle ou annexes à la propriété industrielle, à leur examen et à leur délivrance ou enregistrement et à la surveillance de leur maintien ; il connaît des demandes en nullité et en déchéance de marques mentionnées aux 1° et 2° du I de l’article L. 716-5, ainsi que des oppositions formées à l’encontre des brevets d’invention ; il assure la diffusion des informations techniques, commerciales et financières contenues dans les titres de propriété industrielle ; il statue sur les demandes d’homologation ou de modification des cahiers des charges des indications géographiques définies à l’article L. 721-2 ;

2-1° D’appliquer les dispositions du code de commerce relatives à la tenue du registre national des entreprises prévu à l’article L. 123-36 de ce code, aux prérogatives qui y sont associées et à la diffusion gratuite des informations au public ;

3° De prendre toute initiative en vue d’une adaptation permanente du droit national et international aux besoins des innovateurs et des entreprises ; à ce titre, il propose au ministre chargé de la propriété industrielle toute réforme qu’il estime utile en ces matières ; il participe à l’élaboration des accords internationaux ainsi qu’à la représentation de la France dans les organisations internationales compétentes.
