Article L411-4 of the French Intellectual Property Code

The Director General of the Institut national de la propriété industrielle shall take the decisions provided for in this code when issuing, rejecting or maintaining industrial property titles, as well as when approving, rejecting or amending the specifications of geographical indications defined in Article L. 721-2 or the withdrawal of such approval.

It shall rule on applications for invalidity or revocation of trademarks and on oppositions filed against patents for invention, referred to in 2° of Article L. 411-1. Appeals against these decisions are suspensive

In the exercise of these powers, it is not subject to the supervisory authority. Appeals against its decisions shall be heard directly by the courts of appeal designated by regulation.

An appeal in cassation against the decisions of the courts of appeal ruling on such appeals shall be open to the parties and to the Director General of the National Institute of Industrial Property.

A decree in Council of State shall specify the conditions of application of this Article.

Article L411-4

Le directeur général de l’Institut national de la propriété industrielle prend les décisions prévues par le présent code à l’occasion de la délivrance, du rejet ou du maintien des titres de propriété industrielle, ainsi qu’à l’occasion de l’homologation, du rejet ou de la modification du cahier des charges des indications géographiques définies à l’article L. 721-2 ou du retrait de cette homologation.

Il statue sur les demandes en nullité ou en déchéance de marques et sur les oppositions formées à l’encontre des brevets d’invention, mentionnées au 2° de l’article L. 411-1. Les recours exercés contre ces décisions sont suspensifs

Dans l’exercice de ces compétences, il n’est pas soumis à l’autorité de tutelle. Les cours d’appel désignées par voie réglementaire connaissent directement des recours formés contre ses décisions.

Le pourvoi en cassation contre les décisions des cours d’appel statuant sur ces recours est ouvert aux parties et au directeur général de l’Institut national de la propriété industrielle.

Un décret en Conseil d’Etat précise les conditions d’application du présent article.
