Persons fulfilling the conditions defined in 1° and 2° of article L. 4131-2 may be authorised to practise medicine as an assistant to a doctor:
1° In areas characterised by insufficient healthcare provision or by difficulties in access to healthcare, as determined by order of the Director General of the Regional Health Agency pursuant to 1° of article L. 1434-4;
2° In the event of a seasonal or exceptional influx of people, as determined by an order of the State representative in the département;
3° In the interests of the population, when a specific shortfall in healthcare provision is determined by the Conseil Départemental de l’Ordre des Médecins, where applicable on the recommendation of the mayor of the municipality.
These authorisations are issued for a limited period by the Conseil Départemental de l’Ordre des Médecins, which informs the Agence Régionale de Santé.
A decree, issued after consultation with the Conseil national de l’ordre des médecins, sets the conditions for application of this article, in particular the level of study required depending on the qualification of the assisted practitioner, as well as the maximum duration of authorisations, the procedures for issuing them and the conditions for extending them.
