Article L4161-3 of the French Public Health Code

The profession of midwife is practised illegally by :

1° Any person who habitually performs the acts mentioned in article L. 4151-1 without fulfilling the conditions required by this book for the practice of the profession of doctor or midwife, in particular by articles L. 4111-1, L. 4111-3, L. 4111-7 and L. 4151-5 ;

2° Any person who, in possession of a valid title, exceeds the powers conferred upon him by law, in particular by assisting the persons mentioned in 1°, with a view to circumventing the provisions of this title;

3° Any doctor or midwife who performs the aforementioned acts during the period of a temporary ban imposed in application of article L. 4124-6 ;

4° Any doctor or midwife referred to in article L. 4112-7, who performs the listed acts without fulfilling the conditions or complying with the obligations laid down in the said article.

Article L4161-3

Exerce illégalement la profession de sage-femme :

1° Toute personne qui pratique habituellement les actes mentionnés à l’article L. 4151-1 sans remplir les conditions exigées par le présent livre pour l’exercice de la profession de médecin ou de sage-femme, notamment par les articles L. 4111-1, L. 4111-3, L. 4111-7 et L. 4151-5 ;

2° Toute personne qui, munie d’un titre régulier, sort des attributions que la loi lui confère, notamment en prêtant son concours aux personnes mentionnées au 1°, à l’effet de les soustraire aux prescriptions du présent titre ;

3° Tout médecin ou sage-femme qui pratique les actes susmentionnés pendant la durée d’une peine d’interdiction temporaire prononcée en application de l’article L. 4124-6 ;

4° Tout médecin ou sage-femme mentionné à l’article L. 4112-7, qui exécute les actes énumérés sans remplir les conditions ou satisfaire aux obligations prévues audit article.
