Giving consultations or prescribing treatment while claiming to be able to modify or repress a person’s sexual orientation or gender identity, whether true or assumed, is punishable by two years’ imprisonment and a fine of 30,000 euros.
The offence provided for in the first paragraph is not constituted when the health professional simply invites a person to reflect and exercise caution, particularly in view of their young age, if they are wondering about their gender identity and are considering a medical course leading to a change of sex.
Natural persons guilty of the offence referred to in the first paragraph may also be disqualified from practising the profession of doctor for a period not exceeding ten years.
The acts mentioned in the first paragraph are punishable by three years’ imprisonment and a fine of 45,000 euros when committed to the detriment of a minor or a person whose particular vulnerability or dependence, due to age, illness, infirmity, physical or mental deficiency, pregnancy or precarious economic or social situation, is apparent or known to the perpetrator.
