Article L420-2 of the French Monetary and Financial Code

The manager of a trading platform does not commit its own capital or trade by matching with its own account on the platforms it manages.

Proprietary trading is a form of trading in which a person, the facilitator, acts as an intermediary between the buyer and the seller involved in the trade, so that there is no exposure to market risk throughout the execution of the trade, both sides are executed simultaneously, and the trade is concluded at a price at which the facilitator does not incur any loss or gain, other than pre-disclosed commissions, fees or compensation.

Le gestionnaire d’une plate-forme de négociation n’engage pas ses propres capitaux ni ne négocie par appariement avec interposition de son compte propre sur les plates-formes qu’il gère.

La négociation par appariement avec interposition du compte propre est un mode de transaction dans lequel une personne, le facilitateur, agit en tant qu’intermédiaire entre l’acheteur et le vendeur participant à la transaction, de façon à ce qu’il n’y ait aucune exposition au risque de marché pendant toute la durée de l’exécution de la transaction, les deux volets étant exécutés simultanément, et la transaction étant conclue à un prix grâce auquel le facilitateur n’enregistre ni perte ni gain, hormis des commissions, des honoraires ou des dédommagements communiqués au préalable.
