Article L421-4 of the French Code governing the entry and residence of foreign nationals and the right of asylum

In accordance with article L. 414-13, when the foreign national’s application concerns a profession and a geographical area characterised by recruitment difficulties, the residence permits provided for in articles L. 421-1 and L. 421-3 are issued to him or her without reference to the employment situation.
The same applies to foreign students who, having obtained a diploma at least equivalent to a master’s degree or appearing on a list set by decree in a nationally accredited higher education establishment, wish to take up paid employment and present an employment contract, of indefinite or fixed duration, in relation to their training and with remuneration above a threshold determined by decree and modulated, where applicable, according to the level of diploma concerned.

Article L421-4

Conformément à l’article L. 414-13, lorsque la demande de l’étranger concerne un métier et une zone géographique caractérisés par des difficultés de recrutement, les cartes de séjour prévues aux articles L. 421-1 et L. 421-3 lui sont délivrées sans que lui soit opposable la situation de l’emploi.
Il en va de même de l’étudiant étranger qui, ayant obtenu un diplôme au moins équivalent au grade de master ou figurant sur une liste fixée par décret dans un établissement d’enseignement supérieur habilité au plan national, souhaite exercer un emploi salarié et présente un contrat de travail, à durée indéterminée ou à durée déterminée, en relation avec sa formation et assorti d’une rémunération supérieure à un seuil déterminé par décret et modulé, le cas échéant, selon le niveau de diplôme concerné.
