Article L4211-2 of the French Public Health Code

Pharmacy dispensaries and pharmacies for internal use are required to collect, free of charge, unused medicinal products for human use from private individuals who are in possession of them.

Unused medicines may not be distributed or made available. These medicines are destroyed under secure conditions.

A decree in the Conseil d’Etat shall specify the conditions for the application of this article, and in particular :

– the conditions for the collection of unused medicinal products referred to in the first paragraph ;

– the conditions for the destruction of medicinal products referred to in the second paragraph, and in particular the conditions for financing this destruction.

Les officines de pharmacie et les pharmacies à usage intérieur sont tenues de collecter gratuitement les médicaments à usage humain non utilisés apportés par les particuliers qui les détiennent.

Toute distribution et toute mise à disposition des médicaments non utilisés sont interdites. Ces médicaments sont détruits dans des conditions sécurisées.

Un décret en Conseil d’Etat précise les conditions d’application du présent article, et notamment :

– les conditions de la collecte des médicaments non utilisés mentionnée au premier alinéa ;

– les conditions de la destruction des médicaments mentionnée au deuxième alinéa, et notamment les conditions de financement de cette destruction.
