Article L423-10 of the French Cinema and Moving Image Code

At a meeting to which the accused party is invited, the rapporteur presents the facts of which he has knowledge to the Regulatory Control Commission. He sets out his opinion on these facts and, where appropriate, on the objections notified and his proposed penalty.

During this meeting, the accused person, who may be assisted or represented by any person of his choice, is heard by the Regulatory Control Commission, which may also hear, on the decision of its Chairman and in the presence of the accused person, any person whose hearing it deems likely to contribute to its information.

The Chairman of the Centre national du cinéma et de l’image animée or his representative may attend the meeting and present his observations.

Lors d’une séance à laquelle est convoquée la personne mise en cause, le rapporteur présente devant la commission du contrôle de la réglementation les faits dont il a connaissance. Il expose son opinion sur ces faits, et, le cas échéant, sur les griefs notifiés et sa proposition de sanction.

Au cours de cette séance, la personne mise en cause, qui peut se faire assister ou représenter par toute personne de son choix, est entendue par la commission du contrôle de la réglementation, qui peut également entendre, sur décision de son président et en présence de la personne mise en cause, toute personne dont l’audition lui paraît susceptible de contribuer à son information.

Le président du Centre national du cinéma et de l’image animée ou son représentant peut assister à la séance et présenter ses observations.
