In the event of a breakdown in cohabitation not resulting from the death of one of the spouses, the residence permit issued to the spouse of a foreign national may, for a period of three years following authorisation to reside in France for the purposes of family reunification, be withdrawn or refused renewal.
Where the breakdown in cohabitation occurred prior to the application for the permit, the administrative authority shall refuse to grant the permit.
The provisions of the first paragraph do not apply if one or more children are born of this union, where the foreign national is the holder of a resident permit and can prove that he/she has effectively contributed, since birth, to the upkeep and education of the child or children under the conditions set out in article 371-2 of the Civil Code.
