Article L423-22 of the French Code governing the entry and residence of foreign nationals and the right of asylum

In the year following their eighteenth birthday or if they come under the provisions of article L. 421-35, foreign nationals who were entrusted to the child welfare service or to a trustworthy third party no later than the day they turned sixteen will be issued with a temporary residence permit bearing the words “private and family life” for a period of one year, without the condition set out in article L. 412-1 being applicable.

This permit is issued subject to the real and serious nature of the training prescribed, the nature of the foreign national’s links with his or her family back in his or her country of origin and the opinion of the relevant authorities.

Dans l’année qui suit son dix-huitième anniversaire ou s’il entre dans les prévisions de l’article L. 421-35, l’étranger qui a été confié au service de l’aide sociale à l’enfance ou à un tiers digne de confiance au plus tard le jour de ses seize ans se voit délivrer une carte de séjour temporaire portant la mention ” vie privée et familiale ” d’une durée d’un an, sans que soit opposable la condition prévue à l’article L. 412-1.


Cette carte est délivrée sous réserve du caractère réel et sérieux du suivi de la formation qui lui a été prescrite, de la nature des liens de l’étranger avec sa famille restée dans son pays d’origine et de l’avis de la structure d’accueil ou du tiers digne de confiance sur son insertion dans la société française.
