Article L423-5 of the French Cinema and Moving Image Code

The investigation prior to the pronouncement of sanctions is carried out by a rapporteur, appointed by the Vice-President of the Conseil d’Etat from among serving members of the administrative courts, for a term of three years, renewable once.

The rapporteur is bound by professional secrecy with regard to any facts, acts or information that may have come to his knowledge by virtue of his office, under the conditions and subject to the penalties laid down in articles 226-13 and 226-14 of the French Penal Code.

L’instruction préalable au prononcé des sanctions est assurée par un rapporteur, nommé par le vice-président du Conseil d’Etat parmi les membres en activité des juridictions administratives, pour une durée de trois ans, renouvelable une fois.

Le rapporteur est astreint au secret professionnel pour les faits, actes ou renseignements dont il a pu avoir connaissance en raison de ses fonctions, dans les conditions et sous les sanctions prévues aux articles 226-13 et 226-14 du code pénal.
