Article L423-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The break-up of the relationship is not enforceable when it is attributable to family or domestic violence or when the foreign national has been subjected to polygamy.
In the event of a breakdown in cohabitation attributable to family or domestic violence suffered after the arrival in France of the foreign spouse, but before the first issue of the temporary residence permit, the foreign spouse will be issued with the residence permit provided for in article L. 423-1 provided that the other conditions of this article are met.

La rupture de la vie commune n’est pas opposable lorsqu’elle est imputable à des violences familiales ou conjugales ou lorsque l’étranger a subi une situation de polygamie.

En cas de rupture de la vie commune imputable à des violences familiales ou conjugales subies après l’arrivée en France du conjoint étranger, mais avant la première délivrance de la carte de séjour temporaire, le conjoint étranger se voit délivrer la carte de séjour prévue à l’article L. 423-1 sous réserve que les autres conditions de cet article soient remplies.
