Article L423-8 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the issue of the residence permit provided for in article L. 423-7, when parentage is established with regard to a parent pursuant to article 316 of the Civil Code, the applicant, if he or she is not the author of the acknowledgement of paternity or maternity, must prove that the latter actually contributes to the upkeep and education of the child, under the conditions set out in article 371-2 of the Civil Code, or produce a court decision relating to the contribution to the upkeep and education of the child.
When the parent-subsidiary relationship is established but proof of the contribution is not produced or no court decision has been made, the applicant’s right to residence is assessed with regard to respect for his or her private and family life and with regard to the best interests of the child.

Pour la délivrance de la carte de séjour prévue à l’article L. 423-7, lorsque la filiation est établie à l’égard d’un parent en application de l’article 316 du code civil, le demandeur, s’il n’est pas l’auteur de la reconnaissance de paternité ou de maternité, doit justifier que celui-ci contribue effectivement à l’entretien et à l’éducation de l’enfant, dans les conditions prévues à l’article 371-2 du code civil, ou produire une décision de justice relative à la contribution à l’éducation et à l’entretien de l’enfant.
Lorsque le lien de filiation est établi mais que la preuve de la contribution n’est pas rapportée ou qu’aucune décision de justice n’est intervenue, le droit au séjour du demandeur s’apprécie au regard du respect de sa vie privée et familiale et au regard de l’intérêt supérieur de l’enfant.
