Article L4231-1 of the French Labour Code

Any client or instructing party, informed in writing by an inspecting officer referred to in article L. 8271-1-2 of this code, of the fact that employees of its co-contractor or of a direct or indirect sub-contracting company are subjected to collective accommodation conditions incompatible with human dignity, as referred to inarticle 225-14 of the French Penal Code, shall immediately instruct it in writing to put an end to this situation without delay.

If the reported situation is not remedied, the project owner or client is required to pay for the collective accommodation of the employees, under conditions that comply with the standards adopted pursuant to article L. 4111-6 of this code or, where applicable, article L. 716-1 of the rural and maritime fishing code.

This article does not apply to private individuals who contract with a company for their personal use, that of their spouse, their partner in a civil solidarity pact, their cohabitee or their ascendants or descendants.

Article L4231-1

Tout maître d’ouvrage ou tout donneur d’ordre, informé par écrit, par un agent de contrôle mentionné à l’article L. 8271-1-2 du présent code, du fait que des salariés de son cocontractant ou d’une entreprise sous-traitante directe ou indirecte sont soumis à des conditions d’hébergement collectif incompatibles avec la dignité humaine, mentionnées à l’article 225-14 du code pénal, lui enjoint aussitôt, par écrit, de faire cesser sans délai cette situation.

A défaut de régularisation de la situation signalée, le maître d’ouvrage ou le donneur d’ordre est tenu de prendre à sa charge l’hébergement collectif des salariés, dans des conditions respectant les normes prises en application de l’article L. 4111-6 du présent code ou, le cas échéant, de l’article L. 716-1 du code rural et de la pêche maritime.

Le présent article ne s’applique pas au particulier qui contracte avec une entreprise pour son usage personnel, celui de son conjoint, de son partenaire lié par un pacte civil de solidarité, de son concubin ou de ses ascendants ou descendants.
