Article L4251-6 of the French General Code of Local Authorities

I. – The draft outline plan is adopted by the Regional Council. It is submitted for opinion:

1° To the persons and bodies provided for in 3° to 6° of I of Article L. 4251-5 and to the regional economic, social and environmental council;

2° To the environmental authority;

3° To the territorial conference on public action.

The opinion is deemed to be favourable if it has not been given within three months of the draft outline plan being sent.

II. – The draft outline plan is subject to a public enquiry by the President of the Regional Council, under the conditions set out in Chapter III of Title II of Book I of the Environment Code.

After the public enquiry, the plan may be amended to take account of the opinions received, the comments made by the public and the conclusions of the enquiry commission.

Article L4251-6

I. – Le projet de schéma est arrêté par le conseil régional. Il est soumis pour avis :

1° Aux personnes et organismes prévus aux 3° à 6° du I de l’article L. 4251-5 ainsi qu’au conseil économique, social et environnemental régional ;

2° A l’autorité environnementale ;

3° A la conférence territoriale de l’action publique.

L’avis est réputé favorable s’il n’a pas été rendu dans un délai de trois mois à compter de la transmission du projet de schéma.

II. – Le projet de schéma est soumis à enquête publique par le président du conseil régional, dans les conditions prévues au chapitre III du titre II du livre Ier du code de l’environnement.

Après l’enquête publique, le schéma est éventuellement modifié pour tenir compte des avis recueillis, des observations du public et des conclusions de la commission d’enquête.
