Article L4312-11 of the French Public Health Code

Where it transpires, subsequent to his election, that an elected member of a Council of the Bar, a Disciplinary Chamber or a Social Insurance Section has been subject, before or after his election, to one of the sanctions referred to in 3° and 4° of article L. 4124-6 of this Code and in 3° and 4° of article L. 145-5-2 of the Social Security Code, he shall be automatically declared to have resigned.

This resignation is notified to him :

1° By the president of the council, disciplinary chamber or social insurance section of which he is a member ;

2° Or, where the elected representative concerned is the president of a council, by the president of the National Council;

3° Or, where the elected member is chairman of the National Council, by the vice-chairmen of that Council.

Article L4312-11

Lorsqu’il apparaît, postérieurement à son élection, qu’un élu d’un conseil de l’ordre, d’une chambre disciplinaire ou d’une section des assurances sociales a fait l’objet, avant ou après son élection, d’une des sanctions mentionnées aux 3° et 4° de l’article L. 4124-6 du présent code ainsi qu’aux 3° et 4° de l’articles L. 145-5-2 du code de la sécurité sociale, il est déclaré démissionnaire d’office.

Cette démission lui est notifiée :

1° Par le président du conseil, de la chambre disciplinaire ou de la section des assurances sociales dont il est membre ;

2° Ou, lorsque l’élu concerné est président d’un conseil, par le président du Conseil national ;

3° Ou, lorsque l’élu est président du Conseil national, par les vice-présidents de ce conseil.
