Article L4331-5 of the French Public Health Code

By way of derogation from article L. 4331-2, the following may also practise the profession of occupational therapist and bear the title of occupational therapist, whether or not accompanied by a qualification:

1° In public health establishments caring for people with mental disorders, nurses who joined the occupational therapy profession before 11 April 1983;

2° Employees who have worked mainly as occupational therapists for at least three years during the ten years preceding the date of 23 November 1986 and who have passed, within three years of this date, the knowledge test provided for by a Conseil d’Etat decree. Persons who have passed this test may, depending on their choice, only perform the acts listed by the aforementioned decree in establishments or services providing functional re-education and rehabilitation, mental health or geriatric treatment, respectively.

Article L4331-5

Par dérogation à l’article L. 4331-2, peuvent aussi exercer la profession d’ergothérapeute et porter le titre d’ergothérapeute, accompagné ou non d’un qualificatif :

1° Dans les établissements publics de santé accueillant des personnes atteintes de troubles mentaux, les infirmiers et infirmières intégrés avant le 11 avril 1983 dans un emploi d’ergothérapeute ;

2° Les salariés ayant exercé, à titre principal, l’activité d’ergothérapeute pendant une durée au moins égale à trois ans au cours des dix années précédant la date du 23 novembre 1986 et qui ont satisfait, dans les trois ans suivant cette date, au contrôle des connaissances prévu par un décret en Conseil d’Etat. Les personnes ayant satisfait à ce contrôle ne peuvent, selon leur option, accomplir les actes énumérés par ledit décret que dans des établissements ou services assurant des traitements, respectivement, de rééducation et de réadaptation fonctionnelles, de lutte contre les maladies mentales ou de gériatrie.
