Illegal practice of the profession of occupational therapist or psychomotor therapist is punishable by one year’s imprisonment and a fine of €15,000.
Natural persons are also liable to the following additional penalties:
a) Posting or distributing the decision handed down, in accordance with the conditions set out in article 131-35 of the French Penal Code;
b) Confiscation of the thing that was used or intended to be used to commit the offence or of the thing that is the product of the offence, in accordance with article 131-21 of the Criminal Code;
c) permanent disqualification, or disqualification for a maximum of five years, from practising one or more professions governed by this Code or any other professional or social activity in the course of which the offence was committed, in accordance with the provisions of article 131-27 of the Criminal Code .
Carrying out one of these activities despite a court decision imposing a permanent or temporary ban is punishable by the same penalties.
Legal entities declared criminally liable, under the conditions set out in article 121-2 of the French Penal Code, for the offence defined in this article shall incur, in addition to the fine set out in article 131-38 of the French Penal Code, the penalties set out in 2° to 9° of article 131-39 of the same code.The ban referred to in 2° of article 131-39 of the same code applies to one or more professions governed by this code or any other professional or social activity in the course of which the offence was committed.
