Article L440-4 of the French Monetary and Financial Code

The directors, employees and agents of clearing houses are bound by professional secrecy.

In the case of transactions in financial contracts, clearing houses may disclose information covered by professional secrecy where the laws or regulations of a State that is not a member of the European Union require such information to be reported to a trade repository. Where such information constitutes personal data subject to Act 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, it must be transmitted in accordance with the conditions laid down by the same Act.

Les dirigeants, salariés et préposés des chambres de compensation sont tenus au secret professionnel.

Lors d’opérations sur contrats financiers, les chambres de compensation peuvent communiquer des informations couvertes par le secret professionnel, lorsqu’une législation ou une réglementation d’un Etat qui n’est pas membre de l’Union européenne prévoit la déclaration de ces informations à un référentiel central. Lorsque ces informations constituent des données à caractère personnel soumises à la loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés, leur transmission doit s’effectuer dans les conditions prévues par la même loi.
