Article L443-7 of the French Commercial code

The refusal by any person engaged in production, processing, distribution or service activities to comply with a request made by one of the parties for written confirmation of the terms of a contract not concluded in writing and relating to agricultural and food products is punishable by an administrative fine of up to €75,000 for a natural person and €375,000 for a legal person.

The maximum fine incurred is increased to €150,000 for a natural person and €750,000 for a legal person in the event of a repetition of the breach within two years of the date on which the first request was made.
The maximum fine incurred is increased to €150,000 for a natural person and €750,000 for a legal entity if the breach is repeated within a period of two years from the date on which the first penalty decision became final.

Article L443-7

Le refus par toute personne exerçant des activités de production, de transformation, de distribution ou de services de faire droit à la demande formulée par l’une des parties de confirmation écrite des conditions d’un contrat non conclu sous forme écrite et portant sur des produits agricoles et alimentaires est passible d’une amende administrative dont le montant ne peut excéder 75 000 € pour une personne physique et 375 000 € pour une personne morale.


Le maximum de l’amende encourue est porté à 150 000 € pour une personne physique et 750 000 € pour une personne morale en cas de réitération du manquement dans un délai de deux ans à compter de la date à laquelle la première décision de sanction est devenue définitive.
