Article L4433-10-3 of the French General Code of Local Authorities

At the end of the public enquiry, the regional development plan, possibly amended to take account of the opinions expressed and the results of the enquiry, is adopted by the deliberative assembly of the region, department or local authority.

The draft adopted in this way is forwarded to the Minister responsible for town planning and is approved by decree in the Conseil d’Etat.

When the illegality of certain guidelines or provisions of the plan, or the prejudice they are likely to cause to national interests, is an obstacle to its approval, the minister responsible for town planning, after consulting the Council of State, informs the deliberating assembly so that it can make the necessary changes to these guidelines or provisions by means of a new deliberation.

A l’issue de l’enquête publique, le schéma d’aménagement régional, éventuellement modifié pour tenir compte des avis formulés et du résultat de l’enquête, est adopté par l’assemblée délibérante de la région, du département ou de la collectivité.

Le projet ainsi adopté est transmis au ministre chargé de l’urbanisme et est approuvé par décret en Conseil d’Etat.

Lorsque l’illégalité de certaines orientations ou dispositions du schéma, ou l’atteinte qu’elles sont susceptibles de porter aux intérêts nationaux, fait obstacle à l’approbation de celui-ci, le ministre chargé de l’urbanisme, après la consultation du Conseil d’Etat, en informe l’assemblée délibérante afin qu’elle apporte à ces orientations ou dispositions les modifications nécessaires par une nouvelle délibération.
