The tariffs mentioned in Article L. 444-1 take into account the relevant costs of the service provided and reasonable remuneration, defined on the basis of objective criteria.
As an exception to the first paragraph of this article, provision may be made for equalisation of the tariffs applicable to all the services provided. This equalisation may, in particular, provide that the rates for services relating to goods or rights of a value greater than a threshold set by the joint order provided for in article L. 444-3 be set in proportion to the value of the property or right.
In application of the first two paragraphs of this article, the joint order referred to in the same article L. 444-3 sets the tariffs on the basis of a target average profit rate, the methods of determination of which are defined by a decree in the Conseil d’Etat, and the amount of which is estimated globally for each profession for all the services tariffed pursuant to Article L. 444-1.
Discounts may be granted when a tariff is determined in proportion to the value of a good or a right in application of the second paragraph of this article and when the basis for this tariff is greater than a threshold defined by the joint decree provided for in article L. 444-3. The rate of discounts granted by a professional is fixed, identical for all and within limits defined by regulation. However, for certain services and above an amount of fees set by the joint order referred to in the same article L. 444-3, the professional and his client may agree on the rate of discounts.
