Article L444-6 of the French Commercial code

I. – The officers referred to in II of Article L. 450-1 investigate and record breaches of articles L. 444-4 and L. 444-5 under the conditions set out in articles L. 450-2 to L. 450-8. They may enjoin professionals and their representative bodies to comply with their obligations under the conditions set out in I of Article L. 470-1.

II. – Failure to comply with Articles L. 444-4 and L. 444-5 of this Code and failure to comply with injunctions to comply with these provisions are punishable by an administrative fine of up to €3,000 for a natural person and up to €15,000 for a legal entity. The fine is imposed under the conditions set out in article L. 470-2 of the French Commercial Code.

Article L444-6

I. – Les agents mentionnés au II de l’article L. 450-1 recherchent et constatent les manquements aux articles L. 444-4 et L. 444-5 dans les conditions prévues aux articles L. 450-2 à L. 450-8. Ils peuvent enjoindre aux professionnels et à leurs instances représentatives de se conformer à leurs obligations dans les conditions prévues au I de l’article L. 470-1.

II. – Les manquements aux articles L. 444-4 et L. 444-5 du présent code ainsi que l’inexécution des injonctions de se conformer à ces dispositions sont passibles de l’amende administrative dont le montant ne peut excéder 3 000 euros pour une personne physique et 15 000 euros pour une personne morale. L’amende est prononcée dans les conditions prévues à l’article L. 470-2 du code de commerce.
