Article L444-7 of the French Commercial code

A decree in the Conseil d’Etat, issued after obtaining the opinion of the Autorité de la concurrence, shall specify the terms and conditions for the application of this Title, in particular:

1° The terms and conditions under which the relevant costs and reasonable remuneration, referred to in the first paragraph of Article L. 444-2, are assessed globally for all services subject to charges pursuant to Article L. 444-1;

2° The characteristics of the equalisation provided for in the second paragraph of Article L. 444-2;

3° (Repealed);

4° The list of statistical information referred to in 2° of Article L. 444-5 and the procedures for its regular transmission;

5° The conditions under which, pursuant to the last paragraph of Article L. 444-2, the trader and his customer may agree the rate of discounts.

Article L444-7

Un décret en Conseil d’Etat, pris après avis de l’Autorité de la concurrence, précise les modalités d’application du présent titre, notamment :

1° Les modalités selon lesquelles les coûts pertinents et la rémunération raisonnable, mentionnés au premier alinéa de l’article L. 444-2, sont évalués globalement pour l’ensemble des prestations tarifées en application de l’article L. 444-1 ;

2° Les caractéristiques de la péréquation prévue au deuxième alinéa de l’article L. 444-2 ;

3° (Abrogé) ;

4° La liste des informations statistiques mentionnées au 2° de l’article L. 444-5 et les modalités de leur transmission régulière ;

5° Les conditions dans lesquelles, en application du dernier alinéa de l’article L. 444-2, le professionnel et son client peuvent convenir du taux des remises.
