Article L471-2 of the French Labour Code

The sums paid in must remain unavailable for at least five years. They are made available to the employee or his beneficiaries, at their request, in the event of redundancy, invalidity corresponding to classification in the second and third categories provided for in article L. 310 of the Social Security Code (1), death or retirement of the employee as well as in the event of voluntary departure from the company.

These sums may also be made available to employees benefiting from a business creation leave as provided for in article L. 122-32-12 of this code.

Article L471-2

Les sommes versées doivent demeurer indisponibles pendant au moins cinq ans. Elles sont mises à la disposition du salarié ou de de ses ayants droit, sur leur demande, en cas de licenciement, d’invalidité correspondant au classement dans les deuxième et troisième catégories prévues à l’article L. 310 du code de la sécurité sociale (1), de décès ou de départ à la retraite du salarié ainsi qu’en cas de départ volontaire de l’entreprise.

Ces sommes peuvent également être mises à la disposition des salariés bénéficiaires d’un congé pour la création d’entreprise prévu à l’article L. 122-32-12 du présent code.
