Article L4721-2 of the French Labour Code

The formal notices issued by the Regional Director of Companies, Competition, Consumption, Labour and Employment, drawn up in accordance with the procedures laid down by regulation, set a deadline for completion, taking account of the difficulties involved.

If, on expiry of this deadline, the labour inspector referred to in article L. 8112-1 finds that the dangerous situation has not ceased, he may issue the employer with a statement of offence.

Les mises en demeure du directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi, établies selon des modalités déterminées par voie réglementaire, fixent un délai d’exécution tenant compte des difficultés de réalisation.

Si, à l’expiration de ce délai, l’agent de contrôle de l’inspection du travail mentionné à l’article L. 8112-1 constate que la situation dangereuse n’a pas cessé, il peut dresser procès-verbal à l’employeur.
