When the Labour Inspectorate monitoring officer referred to in Article L. 8112-1 finds that the worker is exposed to a chemical agent which is carcinogenic, mutagenic or toxic for reproduction, and that he is in a proven dangerous situation resulting from one of the offences referred to in this Article, he shall give formal notice to the employer to remedy the situation. If this formal notice is unsuccessful, it will temporarily stop the activity in application of article L. 4731-2.
The infringements justifying the measures mentioned in the first paragraph are :
1° Exceeding an occupational exposure limit value determined by a decree issued in application of article L. 4111-6;
2° Failure or inadequacy of preventive measures and resources as provided for in Chapter II of Title I of Book IV of Part Four with regard to chemical agents that are carcinogenic, mutagenic or toxic to reproduction.
The formal notice is drawn up in accordance with the procedures laid down by regulation.
