Article L4733-9 of the French Labour Code

Within fifteen days of the Labour Inspectorate inspecting officer’s finding, the Regional Director for Business, Competition, Consumer Affairs, Labour and Employment will decide whether to resume performance of the employment contract or training agreement.

Refusal to authorise the resumption of performance of the employment contract or training agreement will result in its termination on the date of notification of the refusal to the parties. In this case, the employer shall pay the young person the sums it would have owed if the employment contract or traineeship agreement had continued to its term.

If the young person is recruited on an open-ended contract, the employer will pay him the sums he would have owed if the employment contract had continued until the end of the vocational training course.

Dans le délai de quinze jours à compter du constat de l’agent de contrôle de l’inspection du travail, le directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi se prononce sur la reprise de l’exécution du contrat de travail ou de la convention de stage.


Le refus d’autoriser la reprise de l’exécution du contrat de travail ou de la convention de stage entraîne sa rupture à la date de notification du refus aux parties. Dans ce cas, l’employeur verse au jeune les sommes dont il aurait été redevable si le contrat de travail ou la convention de stage s’était poursuivi jusqu’à son terme.


En cas de recrutement du jeune sous contrat à durée indéterminée, l’employeur lui verse les sommes dont il aurait été redevable si le contrat de travail s’était poursuivi jusqu’au terme de la formation professionnelle suivie.
