Article L4741-12 of the French Labour Code

Where article L. 4741-11 has been applied, no new offence may be recorded for the same reason during the period which may have been granted.

In the event of a repeat offence recorded in the official report, following a conviction under the aforementioned article, the court may order the total or partial, permanent or temporary closure of the establishment in which the safety or health work required by law has not been carried out.

The ruling may be appealed. In this case, the court will rule as a matter of urgency.

Article L4741-12

Lorsqu’il a été fait application de l’article L. 4741-11, aucune infraction nouvelle ne peut être relevée pour la même cause durant le délai qui a été, le cas échéant, accordé.

En cas de récidive constatée par procès-verbal, après une condamnation prononcée en vertu de l’article précité, la juridiction peut ordonner la fermeture totale ou partielle, définitive ou temporaire, de l’établissement dans lequel n’ont pas été faits les travaux de sécurité ou de salubrité imposés par les dispositions légales.

Le jugement est susceptible d’appel. Dans ce cas, la juridiction statue d’urgence.
