Article L4741-5 of the French Labour Code

In the event of a conviction pursuant to article L. 4741-1, the court may order, as an additional penalty, that the judgment be posted at the doors of the convicted person’s establishments, at the latter’s expense, under the conditions set out inarticle 131-35 of the French Penal Code, and that it be published, in full or in excerpts, in the newspapers it designates. These costs may not exceed the amount of the fine incurred.

In the event of a repeat offence, the court may prohibit the offender from holding certain positions in the company or in one or more categories of companies it defines, for a maximum period of five years.

Failure to comply with this prohibition is punishable by two years’ imprisonment and a fine of €9,000.

En cas de condamnation prononcée en application de l’article L. 4741-1, la juridiction peut ordonner, à titre de peine complémentaire, l’affichage du jugement aux portes des établissements de la personne condamnée, aux frais de celle-ci, dans les conditions prévues à l’article 131-35 du code pénal, et son insertion, intégrale ou par extraits, dans les journaux qu’elle désigne. Ces frais ne peuvent excéder le montant de l’amende encourue.

En cas de récidive, la juridiction peut prononcer contre l’auteur de l’infraction l’interdiction d’exercer, pendant une durée maximale de cinq ans, certaines fonctions qu’elle énumère soit dans l’entreprise, soit dans une ou plusieurs catégories d’entreprises qu’elle définit.

Le fait de méconnaître cette interdiction est puni d’un emprisonnement de deux ans et d’une amende de 9 000 Euros.
