For the application of Articles 81 to 83 of the Treaty establishing the European Community, the Minister responsible for the Economy and the officials designated or empowered by him in accordance with the provisions of this Book, on the one hand, and the Competition Authority, on the other, have the respective powers granted to them by the articles of this Book and by Council Regulation (EC) No 139 / 2004 of 20 January 2004 on the control of concentrations between undertakings and by Council Regulation No 1 / 2003 (EC) of 16 December 2002 on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty establishing the European Community. The procedural rules provided for by these texts are applicable to them.
For the application of Articles 87 and 88 of the Treaty establishing the European Community, the Minister responsible for the economy and the officials designated or authorised by him in accordance with the provisions of Article L. 450-1 have the powers granted to them by Title V of Book IV.
