Article L511-3 of the French Code of civil enforcement procedures

Authorisation is granted by the enforcement judge. However, it may be granted by the president of the commercial court when, requested prior to any legal proceedings, it is intended to preserve a claim falling within the jurisdiction of the commercial court.

L’autorisation est donnée par le juge de l’exécution. Toutefois, elle peut être accordée par le président du tribunal de commerce lorsque, demandée avant tout procès, elle tend à la conservation d’une créance relevant de la compétence de la juridiction commerciale.
