Article L511-84 of the French Monetary and Financial Code

By way of derogation fromarticle L. 1331-2 of the French Labour Code, the total amount of variable remuneration may, in whole or in part, be reduced or give rise to restitution where the person concerned has failed to comply with the rules laid down by the institution with regard to risk-taking, in particular because of his or her responsibility for actions resulting in significant losses for the institution or in the event of failure to comply with the obligations relating to good repute and competence.

Discretionary pension benefits are paid in the form of the financial instruments referred to in Article L. 511-81 of this Code and are deferred for five years from the date on which the person leaves the credit institution or finance company.

Article L511-84

Par dérogation à l’article L. 1331-2 du code du travail, le montant total de la rémunération variable peut, en tout ou partie, être réduit ou donner lieu à restitution lorsque la personne concernée a méconnu les règles édictées par l’établissement en matière de prise de risque, notamment en raison de sa responsabilité dans des agissements ayant entraîné des pertes significatives pour l’établissement ou en cas de manquement aux obligations d’honorabilité et de compétence.

Le versement des prestations de pension discrétionnaires est effectué sous forme d’instruments financiers mentionnés à l’article L. 511-81 du présent code et est différé de cinq ans à compter du départ de la personne de l’établissement de crédit ou la société de financement.
