Advertising or propaganda, in any form whatsoever, relating to objects, devices and methods, presented as favouring the diagnosis, prevention or treatment of diseases, conditions relating to surgical pathology and physiological disorders, the diagnosis or modification of the physical or physiological state, the restoration, correction or modification of organic functions, may be prohibited by the Agence nationale de sécurité du médicament et des produits de santé, where it has not been established that the said objects, devices and methods possess the properties advertised. The Agence nationale de sécurité du médicament et des produits de santé may also make such advertising or propaganda subject to the obligation to mention the warnings and precautions for use necessary to inform the consumer.
The ban is imposed after the manufacturer, importer or distributor of the said objects and devices or the promoter of the said methods has been invited to present its observations. It takes effect three weeks after its publication in the Official Journal. It may then be enforced against the manufacturer, importer, distributor or promoter, as well as against persons who solicit or have solicited the prohibited advertising or propaganda and against advertising or distribution agents.
