Article L5124-17-1 of the French Public Health Code

An on-call system is organised to meet urgent requirements for medicinal products outside the opening days generally used by wholesaler-distributors in their territory of distribution.

All the wholesaler-distributors mentioned in the first paragraph are required to participate in this system.

The organisation of the on-call system is regulated by the organisations representing the profession. In the absence of an agreement, or if the organisation chosen does not meet public health needs, a decision by the Director General of the regional health agency with territorial jurisdiction governs the organisation of the said system.

The procedures for organising the on-call system are determined by decree in the Conseil d’Etat.

Un système d’astreinte est organisé pour répondre aux besoins urgents en médicaments en dehors des jours d’ouverture généralement pratiqués par les grossistes-répartiteurs sur leur territoire de répartition.

Tous les grossistes-répartiteurs mentionnés au premier alinéa sont tenus de participer à ce système.

L’organisation du système d’astreinte est réglée par les organisations représentatives de la profession. A défaut d’accord ou si l’organisation retenue ne permet pas de satisfaire les besoins en santé publique, une décision du directeur général de l’agence régionale de santé territorialement compétente règle l’organisation dudit système.

Les modalités d’organisation du système d’astreinte sont déterminées par décret en Conseil d’Etat.
