Any business that includes at least one pharmaceutical establishment must be owned by a pharmacist or by a company in whose management or general management a pharmacist participates. It may be wholly or partly leased to a company. This company must be owned by a pharmacist or involve the participation of a pharmacist in its general management or management.
The pharmacists mentioned in the previous paragraph are referred to as responsible pharmacists. They are personally liable for compliance with the provisions relating to their activity, without prejudice, where applicable, to the joint and several liability of the company.
In each pharmaceutical establishment of the company, a delegated pharmacist ensures compliance with the provisions of this book under the authority of the company’s responsible pharmacist. Where the pharmacist in charge performs his duties in one of the pharmaceutical establishments of a company, the appointment of a delegate pharmacist is not compulsory in that establishment.
Responsible pharmacists and delegate pharmacists must have appropriate practical experience.
