I.-In the regional hospital groupings mentioned in article L. 6132-1, the shared medical project includes a pharmacy project which organises cooperation on the tasks mentioned in I of article L. 5126-1 within the establishments belonging to the grouping. To this end, this project may:
1° Provide for cooperation arrangements between the internal-use pharmacies of the establishments belonging to the grouping and with those of establishments not belonging to the grouping;
2° Designate the in-house pharmacy responsible for meeting the pharmaceutical needs of patients cared for by establishments belonging to the grouping which do not have an in-house pharmacy;
3° Entrusting the inter-institutional centre provided for in III of article L. 6132-3, or the internal-use pharmacy of an institution that is a member of the group, with coordinating the internal-use pharmacies of the institutions that are members of the group.
The establishments referred to in 6° of the I of article L. 312-1 of the Code de l’action sociale et des familles that are part of a groupement hospitalier de territoire and do not have an in-house pharmacy may derogate from the groupement hospitalier de territoire’s pharmacy project with a view to entering into the agreement provided for in II of article L. 5126-10 of this code.
II – In health cooperation groups authorised to have an in-house pharmacy in application of 1° of article L. 6133-1, or covered by 4° of article L. 6133-1 or the provisions of article L. 6133-7, the constituent agreement organises the coordination of pharmaceutical activities within the group. To this end, it may :
1° Set out the arrangements for meeting the pharmaceutical needs of the people cared for by the establishments or by the grouping covered by 4° of article L. 6133-1 or by the provisions of article L. 6133-7 who do not have an in-house pharmacy. The agreement may designate the in-house pharmacy responsible for meeting these needs;
2° Providing for the arrangements for cooperation between the internal-use pharmacies within the grouping and with those of establishments, services or organisations that are not members of the grouping.
III – For the application of I, the army hospitals associated with a regional hospital grouping are considered to be establishments that are members of this grouping.
