I. – The Director General of the Regional Health Agency may authorise, for a limited period, the in-house pharmacies of public health establishments:
1° To supply other in-house pharmacies when there is no other possible source of supply for a given medicinal product or product. However, in the case of an imperative and immediate need, the supply may be carried out without the authorisation provided for in the previous paragraph, subject to informing the general director of the regional health agency without delay;
2° To retail medicines that are out of stock or at risk of being out of stock, the sale of which to the public has been authorised by the Agence nationale de sécurité du médicament et des produits de santé in application of article L. 5121-30.
II. – In the event of an emergency, public health establishments are authorised to wholesale, without making a profit, medicines that are not otherwise available to non-profit-making humanitarian organisations, as well as to the State for the performance of its humanitarian missions.
III. – The Director General of the Regional Health Agency may issue the authorisations provided for in this article to establishments, services or organisations which come under, or which are placed under the supervision of, the Minister of Defence or the Minister responsible for Veterans, with the agreement of the Minister concerned.
