Article L5126-8 of the French Public Health Code

I. – The Director General of the Regional Health Agency may authorise, for a limited period, the in-house pharmacies of public health establishments:

1° To supply other in-house pharmacies when there is no other possible source of supply for a given medicinal product or product. However, in the case of an imperative and immediate need, the supply may be carried out without the authorisation provided for in the previous paragraph, subject to informing the general director of the regional health agency without delay;

2° To retail medicines that are out of stock or at risk of being out of stock, the sale of which to the public has been authorised by the Agence nationale de sécurité du médicament et des produits de santé in application of article L. 5121-30.

II. – In the event of an emergency, public health establishments are authorised to wholesale, without making a profit, medicines that are not otherwise available to non-profit-making humanitarian organisations, as well as to the State for the performance of its humanitarian missions.

III. – The Director General of the Regional Health Agency may issue the authorisations provided for in this article to establishments, services or organisations which come under, or which are placed under the supervision of, the Minister of Defence or the Minister responsible for Veterans, with the agreement of the Minister concerned.

Article L5126-8

I. – Le directeur général de l’agence régionale de santé peut autoriser, pour une durée limitée, les pharmacies à usage intérieur des établissements publics de santé :

1° A approvisionner d’autres pharmacies à usage intérieur lorsqu’il n’y a pas d’autre source d’approvisionnement possible pour un médicament ou produit déterminé. Toutefois, pour un besoin impératif et immédiat, l’approvisionnement peut être effectué sans l’autorisation prévue à l’alinéa précédent, sous réserve d’en informer sans délai le directeur général de l’agence régionale de santé ;

2° A vendre au détail des médicaments en rupture ou en risque de rupture dont la vente au public a été autorisée par l’Agence nationale de sécurité du médicament et des produits de santé en application de l’article L. 5121-30.

II. – En cas d’urgence, les établissements publics de santé sont autorisés à vendre en gros, sans réaliser de bénéfices, des médicaments non disponibles par ailleurs à des organisations à but non lucratif et à vocation humanitaire, ainsi qu’à l’Etat pour l’exercice de ses missions humanitaires.

III. – Le directeur général de l’agence régionale de santé peut délivrer les autorisations prévues au présent article aux établissements, services ou organismes qui relèvent, ou qui sont placés sous la tutelle, du ministre de la défense ou du ministre chargé des anciens combattants après accord du ministre concerné.
