Article L5139-2 of the French Public Health Code

The production, manufacture, transport, import, export, possession, offer, transfer, acquisition and use of micro-organisms and toxins included on the list provided for in article L. 5139-1 and products containing them are subject to conditions and an authorisation system defined by decrees of the Conseil d’Etat. These decrees may, after consultation with the national academies of medicine and pharmacy, prohibit any operation relating to these micro-organisms, toxins and products containing them and, in particular, prohibit their prescription and incorporation into preparations.

The conditions for prescribing and dispensing preparations in which the micro-organisms or toxins mentioned in article L. 5139-1 or products containing them are incorporated are set after consultation with the national councils of the medical and pharmaceutical orders.

Article L5139-2

La production, la fabrication, le transport, l’importation, l’exportation, la détention, l’offre, la cession, l’acquisition et l’emploi des micro-organismes et toxines inscrits sur la liste prévue à l’article L. 5139-1 et les produits en contenant sont soumis à des conditions et à un régime d’autorisation définis par décrets en Conseil d’Etat. Ces décrets peuvent, après avis des académies nationales de médecine et de pharmacie, prohiber toute opération relative à ces micro-organismes, toxines et produits qui en contiennent et, notamment, interdire leur prescription et leur incorporation dans des préparations.

Les conditions de prescription et de délivrance des préparations dans lesquelles sont incorporés des micro-organismes ou des toxines mentionnés à l’article L. 5139-1 ou les produits qui en contiennent sont fixées après avis des conseils nationaux de l’ordre des médecins et de l’ordre des pharmaciens.
