I.-Only the following may prepare veterinary medicinal products extemporaneously, hold them with a view to selling them to users and dispense them by retail, whether free of charge or in return for payment:
1° Pharmacists holding a dispensary ;
2° Without, however, having the right to keep a dispensary open, veterinary surgeons entered on the roll of the Order who have satisfied the conditions of article L. 241-1 of the Rural and Maritime Fishing Code allowing them to practise animal medicine and surgery, when it concerns animals for which they personally provide care or whose health surveillance and care are regularly entrusted to them. For these animals, the same right is also granted to veterinarians who have fulfilled the obligations of Chapter I of Title IV of Book II of the Rural and Maritime Fishing Code and who practise animal medicine and surgery within the same professional domicile, as defined in the code of ethics provided for in article L. 242-3 of the Rural and Maritime Fishing Code.
The same right is granted to holders of the State diploma of veterinary doctor or doctor of pharmacy designated by the director of the veterinary school as responsible for the pharmacy for the treatment of animals admitted for consultation or hospitalised, as well as to army veterinary surgeons for animals under the responsibility of the Ministry of Defence and those under the responsibility of other ministries for whose health care and surveillance they are personally responsible within the framework of an inter-ministerial protocol agreement.
II – The present article does not apply to the holding with a view to sale to users or to the retail supply, whether free of charge or in return for payment:
a) Antiparasitic products intended for the external treatment of pet animals, with the exception of those subject to compulsory prescription by a veterinarian in application of article L. 5143-5 or for which the marketing authorisation states that they are not to be applied to the animal in their current state ;
b) Veterinary medicinal products subject to registration in accordance with Article L. 5141-5-1.
III – A decree in the Conseil d’Etat, issued after obtaining the opinion of the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail, sets the conditions under which veterinary medicinal products not subject to veterinary prescription may be sold remotely pursuant to Article 104 of Regulation (EU) 2019/6, in particular the obligation to declare remote sales sites, the conditions they must meet, and the competent administrative authority responsible for monitoring this activity.
