Article L517-11-2 of the French Monetary and Financial Code

Where the parent undertaking of an investment firm is a mixed-activity holding company, the Autorité de contrôle prudentiel et de résolution responsible for the supervision of the investment firm may monitor transactions between the investment firm, the mixed-activity holding company and subsidiaries of the mixed-activity holding company, and require the investment firm to implement adequate risk management and internal control procedures, including sound reporting and accounting procedures, to identify, measure, monitor and control such transactions.

Lorsque l’entreprise mère d’une entreprise d’investissement est une compagnie holding mixte, l’Autorité de contrôle prudentiel et de résolution chargée de la surveillance de l’entreprise d’investissement peut surveiller les transactions entre l’entreprise d’investissement, la compagnie holding mixte et les filiales de cette dernière, et exiger de l’entreprise d’investissement qu’elle mette en place des procédures adéquates de gestion des risques et de contrôle interne, y compris des procédures saines d’information et de comptabilité permettant d’identifier, de mesurer, de suivre et de contrôler ces transactions.
