An intermediate parent undertaking in the European Union is a credit institution or a financial holding company or a mixed financial holding company which has applied for approval in accordance with the provisions of L. 517-13, whose subsidiaries, which are exclusively or mainly credit institutions or investment firms, are part of a group whose parent undertaking is established in a third country and which, for at least two of these subsidiaries, are located within the territory of the European Union.
Where none of the subsidiaries mentioned above is a credit institution or where, in accordance with the second to fourth paragraphs of Article L. 517-11, the second intermediate parent undertaking is established in connection with investment activities, the intermediate parent undertaking or the second intermediate parent undertaking may be an investment firm.
