Article L519-4 of the French Monetary and Financial Code

Any intermediary in banking transactions and payment services who, even on an occasional basis, is entrusted with funds as an agent of the parties, is required at all times to provide evidence of a financial guarantee specifically allocated to the repayment of these funds to customers.

This guarantee may only result from a guarantee undertaking given by a credit institution or finance company authorised for this purpose or an insurance or capitalisation company governed by the Insurance Code.

Tout intermédiaire en opérations de banque et en services de paiement, qui, même à titre occasionnel, se voit confier des fonds en tant que mandataire des parties, est tenu à tout moment de justifier d’une garantie financière spécialement affectée au remboursement de ces fonds aux clients.

Cette garantie ne peut résulter que d’un engagement de caution pris par un établissement de crédit ou une société de financement habilité à cet effet ou une entreprise d’assurance ou de capitalisation régie par le code des assurances.
