In the event of an infringement by the operator of a general shop of the provisions of this chapter or of the decrees of the Council of State made for the application of the said provisions, the prefect may, after hearing the operator, pronounce by order, temporarily or definitively, the withdrawal of approval.
In this case, the president of the court, ruling on a petition or in summary proceedings, shall appoint, at the request of the public prosecutor, a provisional administrator and determine the powers available to him for the operation of the establishment.
In the event of permanent withdrawal of approval and where the interests of local trade require the general shop to be maintained, the powers of the provisional administrator may include putting the business and the equipment necessary for its operation up for public auction.
Permanent withdrawal of approval may also be ordered against establishments that have ceased to operate as general shops or warehouses for at least two years.
