Where several communes own undivided property or rights, a legal entity governed by public law shall be created for their management and for the management of the related public services, administered in accordance with the procedures set out in Article L. 5222-2, by a syndicate commission made up of delegates from the municipal councils of the communes concerned and by the municipal councils of these communes.
The decision to set up the syndicate commission is taken by order of the State representative in the department or by joint order of the State representatives in the departments concerned when the communes belong to different departments.
Each of the municipal councils elects from among its members, by secret ballot, the number of delegates set by the decision to set up the commission. From among the delegates, one or more vice-chairmen are appointed, whose number may not exceed 10% of all the members of the syndicate commission.
If a municipal council neglects or refuses to appoint its delegates, the mayor represents the commune on the syndicate commission.
The syndicate committee is chaired by a syndic elected by and from among the delegates. It is renewed after each general renewal of the municipal councils.
The deliberations of the syndicate commission and the decisions of the syndic are subject to all the rules established for the deliberations of the municipal councils and the decisions of the mayors.
