Article L5222-3 of the French General Code of Local Authorities

On the proposal of the syndicate commission and on the decision of the municipal councils of two thirds of the communes representing more than half of their total population, or of at least half of the municipal councils representing more than two thirds of the population, a syndicate of communes may be created whose powers are at least those of the syndicate commission as set out in Article L. 5222-2.

However, for property held in undivided ownership on the date of the constitution of the syndicat de communes and unless the municipal councils have decided otherwise by concordant deliberation, the rules for sale or exchange and those relating to transactions are those defined in article L. 5222-2.

Sur proposition de la commission syndicale et sur décision des conseils municipaux des deux tiers des communes représentant plus de la moitié de la population totale de celles-ci, ou de la moitié au moins des conseils municipaux représentant plus des deux tiers de la population, il peut être créé un syndicat de communes dont les compétences sont au minimum celles de la commission syndicale telles qu’elles sont fixées à l’article L. 5222-2.

Toutefois, pour les biens compris dans l’indivision à la date de la constitution du syndicat de communes et sauf si, par des délibérations concordantes, les conseils municipaux en ont décidé autrement, les règles de vente ou d’échange et celles relatives aux transactions sont celles définies à l’article L. 5222-2.
