I. – Before commencing business, bureaux de change shall obtain an authorisation issued by the Autorité de contrôle prudentiel et de résolution, which shall verify that the undertaking meets the following requirements:
a) It is registered in the Trade and Companies Register ;
b) It has paid-up capital or a guarantee from a credit institution, finance company or insurance company for an amount at least equal to a sum set by order of the Minister for the Economy;
c) Its directors and beneficial owners provide evidence that they are of good repute and have the necessary skills, under conditions defined by decree and in accordance with procedures laid down by order of the Minister for the Economy.
II. – Any change affecting a manual changer’s compliance with the obligations set out in I must be subject to the prior authorisation of the Autorité de contrôle prudentiel et de résolution, a declaration or a notification, as applicable, in accordance with the conditions set by an order of the Minister for the Economy.
III. – The Autorité de contrôle prudentiel et de résolution may withdraw the authorisation held by a manual changer, either at the request of the institution or on its own initiative, if the manual changer has not used the authorisation within twelve months or has not been in business for at least six months.
IV. – The Autorité de contrôle prudentiel et de résolution publishes the list of manual money changers in accordance with the procedures defined by order of the Minister responsible for the economy.
