As an exception to Book III of the Code of Relations between the Public and the Administration, when the personal interview has been transcribed and audio recorded, the applicant may only have access to this recording after notification of the negative decision of the French Office for the Protection of Refugees and Stateless Persons on the asylum application and for the purposes of appealing against this decision. This access, which is provided under secure conditions defined by order of the minister responsible for asylum, may be obtained from the Office or, in the event of an appeal, from the Cour nationale du droit d’asile. In the event of an appeal under article L. 352-4, such access may also be obtained from the administrative court.
The dissemination by any person of an audio recording made by the Office of a personal interview conducted with an asylum seeker is punishable by one year’s imprisonment and a fine of 15,000 euros.
